Traffic Tickets and DUI

“Traffic ticket” doesn’t sound all that serious to many people. It’s a headache, an aggravation that can ruin your mood for the day, a bit of money out of your pocket that you might not want to part with. But, some traffic violations are much more serious than that. . And, even a relatively minor traffic violation can be serious if you’re a new driver, a commercial driver, or a driver who already has recent violations on your record.

Driving under the influence (DUI), also known as OWI, DWI, or OUI in some states, is among the most serious traffic violations. But, it’s not the only one. Other offenses, such as reckless driving or operating without insurance, may also result in driver’s license suspension in many states.

Traffic tickets can also impact your auto insurance rates, and that can sometimes be avoided through court supervision or a diversion program.

And, most states have a cumulative system that means two or three relatively minor traffic violations in a certain period of time can add up to a suspension.

Should I Hire a Traffic Ticket Lawyer?

If you are unsure about your options, anxious about the outcome, or have special concerns about your ticket, you may want to hire a traffic ticket lawyer. The only way to find out what energy may be able to offer you in this situation is to speak with one.

That said, there are certain circumstances in which it is usually in your best interest to retain an attorney to handle your traffic ticket. These include:

• When you make your living driving, even if you do not have a CDL
• When the citation is for a misdemeanor charge rather than an infraction
Some traffic violations are crimes. For example, reckless driving is a misdemeanor in some states. A conviction on a criminal traffic offense can have a different impact than and in fraction. Driving Under the Influence

(DUI)

DUI laws vary somewhat from state to state, but there are some common threads. In every state, it is against the law to operate a motor vehicle with a blood alcohol level (BAL) of .08 or greater. In other words, if your BAL is .08 or higher, you may be convicted of a crime even if you are showing no signs of impairment. In most states, you can also be convicted with a lower BAL if you show signs of impairment.

Depending on the state, your blood alcohol level, whether you have had a prior DUI conviction, and other variables, conviction for driving under the influence can result in:
The consequences of a DUI conviction can extend far beyond what the court imposes. For example, a DUI can disqualify you from certain types of employment.

If you've been charged with DUI, it is very important that you understand all of the direct and indirect consequences before you make a decision about how to proceed. The prosecuting attorney may offer you what sounds like a good deal, but the prosecutor is under no obligation to warn you about indirect consequences. That's why it's important to get your information from an attorney who is on your side.
● Possible jail time
● Fines
● Driver's license suspension
● Mandatory alcohol assessment or counseling
● An ignition interlock device installed on your vehicle
● Probation
● Community service
● A requirement that you carry expensive high risk automobile insurance
