Dog Bites in Children

Children are at greater risk from dog bites for several reasons. Some of the most common include:
•  Children have less developed judgment about how to interact with dogs, particularly unknown dogs
•  Children are more likely to panic and run, scream, or otherwise act in ways that further agitate the dog if there is a problem
•  Children are lower to the ground, which means dogs have easier access to vulnerable body parts such as the face and neck
•  Children’s smaller size can mean that a bite causes more damage than it would have in an adult

Dog Bite Laws Vary from State to State

In some states, a dog’s owner (or another person who has control of the dog) is strictly liable for injuries caused by the dog. That means the owner is responsible for the dog’s actions, even if the owner didn’t do anything wrong.

Other states follow the “one bite rule,” meaning that the owner is strictly liable only if the dog has bitten before. Once the dog has shown a “vicious propensity,” the owner is on notice that the animal could present a danger to others, and so is responsible for preventing future attacks.

Finally, some states apply negligence law, just as they would in a car accident or slip and fall case. The owner will be liable for injuries caused by the dog if the owner didn’t exercise reasonable care to prevent the injury.

There are other variations within these three general rules. For instance, in some states dog bites to children are treated differently. In some states, the rules are different depending on where the bite takes place and why the bite victim was there.
